If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To access certain features, you must create an account. You may register using email/password or through third-party authentication providers (Google, Apple). You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security and confidentiality of your login credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

3. The Service

3.1 What We Provide

OneResume.ai is an AI-powered resume optimization platform that provides:

A Master Career Profile builder for storing your career history
AI-powered resume tailoring for specific job descriptions
ATS (Applicant Tracking System) compatibility scoring and optimization
AI-generated cover letters
Match Score analysis between your profile and job descriptions
Resume export in PDF and DOCX formats
Application tracking tools

3.2 AI-Generated Content

The Service uses artificial intelligence to generate, modify, and optimize resume content based on your input. You acknowledge and agree that:

You are solely responsible for reviewing, verifying, and approving all AI-generated content before use. AI output may contain inaccuracies, fabrications, or content that does not accurately reflect your qualifications.
You must not submit resumes containing false information to employers, regardless of whether that information was AI-generated or manually entered.
AI output is not professional advice. The Service does not provide legal, career counseling, or employment advice. Consult appropriate professionals for specific guidance.
Results are not guaranteed. We do not guarantee that using the Service will result in job interviews, job offers, or improved ATS scores with any specific employer or ATS platform.

3.3 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free access. We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. Scheduled maintenance will be communicated in advance when feasible.

4. Subscriptions and Payments

4.1 Plans

The Service is offered through free and paid subscription plans. Features, usage limits, and pricing for each plan are described on our Pricing page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe, our third-party payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. All fees are in U.S. dollars unless otherwise stated.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You retain access to paid features until the end of the period you have already paid for. We do not provide prorated refunds for partial billing periods.

4.4 Refunds

Refund requests may be submitted within 7 days of initial subscription purchase by contacting support@oneresume.ai. Refunds are issued at our sole discretion. Refunds are not available for renewal charges or after the 7-day window.

5. Intellectual Property

5.1 Your Content

You retain ownership of all personal data, career information, and original content you provide to the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to process, store, and transform Your Content solely for the purpose of providing and improving the Service. This license terminates when you delete your account or Your Content.

5.2 AI-Generated Output

You own the AI-generated output (tailored resumes, cover letters, summaries) created by the Service using Your Content. You may use this output for any lawful purpose, including submitting it to potential employers.

5.3 Our Intellectual Property

The Service, including its design, algorithms, scoring methodologies, templates, software, trademarks, and documentation, is owned by OneResume.ai and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property except the limited right to use the Service as described herein.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Submit false, misleading, or fraudulent information to employers using content generated by the Service
Attempt to reverse-engineer, decompile, or extract the source code of the Service or its algorithms
Circumvent usage limits, rate limits, or access controls
Use automated tools (bots, scrapers) to access the Service without our written permission
Resell, sublicense, or redistribute the Service or its output for commercial purposes (e.g., operating a competing resume service using our platform)
Upload malicious code, viruses, or content that infringes third-party rights
Impersonate any person or entity, or misrepresent your affiliation
Interfere with or disrupt the Service's infrastructure or other users' access

Violation of these terms may result in immediate suspension or termination of your account without refund.

7. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Third-Party Services

The Service integrates with third-party providers including but not limited to:

Firebase (Google) for authentication and data storage
Stripe for payment processing
SendGrid for email communications
X.ai (Grok) for AI processing

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

The Service will meet your specific requirements or expectations
AI-generated content will be accurate, complete, or free of errors
ATS scores or Match Scores predict actual employer ATS outcomes
Use of the Service will result in job interviews or employment
The Service will be uninterrupted, timely, secure, or error-free

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONERESUME.AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

Your use of or inability to use the Service
Any AI-generated content or recommendations
Unauthorized access to or alteration of your data
Any third-party conduct on the Service
Any employment decisions made by third parties

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to indemnify, defend, and hold harmless OneResume.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Service
Your violation of these Terms
Content you submit that is false, misleading, or infringes third-party rights
Your use of AI-generated content in applications to employers

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms, with or without notice. Upon termination:

Your right to use the Service ceases immediately
We may delete your account data after a reasonable retention period (typically 30 days), unless required by law to retain it longer
You may request export of your data prior to termination by contacting support
Provisions that by their nature should survive termination shall survive, including Sections 5, 9, 10, 11, and 13

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

13.2 Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association. The arbitration shall take place in the State of Delaware or remotely, at the election of the parties. Each party shall bear its own costs, and the arbitrator's decision shall be final and binding.

13.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the infringement or misappropriation of intellectual property rights.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.

15. Miscellaneous

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and OneResume.ai regarding the Service.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
Force Majeure. We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet outages, or third-party service failures.
